Terms and Conditions:
1. Acceptance of Medical Consultation: The applicant agrees to use the Global platform, fully aware that the doctors on the platform are only authorized to provide medical consultation and are not permitted to perform any treatment, practice medicine, or prescribe medication. The consultations provided are solely based on the information the applicant provides during the consultation session, and the accuracy and completeness of this information are the applicant’s responsibility.
2. Limitations of Online Consultation: The applicant acknowledges the limitations of online consultation, including the inability to conduct physical examinations, medical imaging, or diagnostic tests. The applicant agrees that the consultations provided should be considered as complementary advice and should not replace an in-person visit to a doctor.
3. Non-Refundable Payment Commitment: After receiving a consultation from the doctors on the platform, the payment made by the applicant is non-refundable. This condition applies even if the applicant is dissatisfied with the consultation outcome.
4. Prescription with Legal Authorization: If one of the doctors on the platform holds a license to practice medicine in the applicant’s province or state of residence, the applicant may request a prescription. However, the applicant is responsible for verifying the doctor’s license and ensuring that the prescription complies with local laws before receiving it.
5. Limitation of Global Platform Liability: The Global platform acts only as an intermediary connecting applicants with doctors and holds no responsibility for the content of the consultations, the accuracy or completeness of the information provided by the doctors, or the outcomes of the consultations. The applicant assumes full responsibility for using the consultations provided.
6. Awareness and Acceptance of Terms by the Applicant: The applicant, fully aware of the terms and conditions of the Global platform, submits their request and accepts all the mentioned conditions. This acceptance is considered final and irrevocable.
7. Collection and Use of Personal Information: Global collects personal information from the applicant, including gender, age, area of residence, phone number, email, and full name, and may use this information for advertising and marketing purposes. By using the platform, the applicant consents to this.
8. Commitment to Confidentiality: Global commits to not disclosing the applicant’s personal information to any entity and considers all stored information confidential. Such information may only be shared with others if required by law or with the applicant’s written consent.
9. Responsibility for Disclosure by Doctors: Global holds no responsibility for any disclosure of the applicant’s personal information by doctors. However, all doctors are required to sign Non-Disclosure Agreements (NDAs) with the Global platform to ensure the protection of the applicant’s information.
10. Language and Location Limitations of Doctors: The Global platform emphasizes providing consultations in the applicant’s native language. However, doctors may be located in a country other than the applicant’s residence, which may result in differences in medical practices and standards. The applicant is responsible for being aware of these differences.
11. No Establishment of Doctor-Patient Relationship: Using the Global platform and receiving consultations from the doctors on it does not automatically establish a doctor-patient relationship. These consultations are supplementary and educational and do not replace in-person healthcare or diagnostic services.
12. Commitment to Local Laws: The applicant is responsible for ensuring that the use of the Global platform and the consultations received comply with local laws. If the use of these services is illegal in the applicant’s jurisdiction, the applicant assumes full responsibility for any legal consequences.
13. Limitations in Emergency Cases: The Global platform is not designed for medical emergencies. In the event of any emergency, the applicant should immediately visit the nearest healthcare facility. The Global platform and its doctors hold no responsibility for consultations provided during emergencies.
14. Responsibility for Accuracy of Information Provided: The applicant is responsible for providing accurate and complete information about their health status to the doctors. Any deficiencies or mistakes in providing information may lead to incorrect advice, and the applicant assumes full responsibility for this.
15. Intellectual Property Rights: All content provided on the Global platform, including consultations, texts, videos, and other materials, is the intellectual property of Global, and the applicant is not permitted to use, copy, or distribute this content without written permission from the company.
16. Consent to Receive Promotional Communications: By using the Global platform, the applicant consents to receive emails, text messages, and other promotional communications from Global. The applicant may opt out of receiving promotional messages at any time through the methods provided in these communications.
17. Changes to Terms and Conditions: Global reserves the right to change the terms and conditions of using the platform at any time and without prior notice. These changes will automatically apply as part of the agreement with the applicant once published on the Global platform website.
18. Withdrawal and Access Termination: Global reserves the right to temporarily or permanently terminate the applicant’s access to the platform if any terms and conditions are violated. In the event of access termination, no refund will be issued to the applicant.
19. Governing Law and Dispute Resolution: These terms and conditions are governed by the laws of Canada, and any disputes arising from the use of the Global platform must be resolved through arbitration in Canada. The arbitration must be conducted in accordance with applicable laws, and the arbitrator’s decision is binding on both parties.
20. Mutual Responsibilities: The applicant assumes full responsibility for using the Global platform and the consultations provided. Global is also obligated to provide its services consistently and at the highest quality level but does not guarantee the flawless delivery of services or the outcomes of consultations.
21. Acceptance of Terms Before Use: By accessing the Global platform and using its services, the applicant automatically agrees to all the existing terms and conditions. If the applicant disagrees with any of these terms, they should not use the platform’s services.
22. Protection of Applicant’s Data: Global is committed to implementing strict security policies to ensure the safety and confidentiality of the applicant’s data. This data is stored on secure servers and used only for purposes agreed upon by the applicant.
23. Limited Liability for Damages: Global holds no liability for direct, indirect, or consequential damages arising from the use of the platform. This limitation of liability includes loss of data, income, or other economic losses.
24. Transfer of Rights and Obligations: The applicant is not permitted to transfer or assign their rights or obligations under these terms and conditions to another person or entity without written consent from Global. Global reserves the right to transfer its rights and obligations to any person or entity without prior notice to the applicant.
25. Mutual Obligations in Force Majeure Conditions: In the event that force majeure conditions (such as war, earthquake, flood, fire, or any other unforeseen circumstance) prevent either party from fulfilling their obligations, Global and the applicant will be exempt from performing their obligations but are required to fulfill their obligations to the best extent possible once the force majeure conditions are resolved.
26. Feedback and Complaints Policy: Global welcomes feedback and complaints from applicants and is committed to carefully reviewing this feedback and taking corrective actions if necessary. The applicant can submit their complaints through the communication channels specified on the website.
27. Membership in Discount and Loyalty Programs: Global may offer discount or loyalty programs to its applicants. The terms and conditions of these programs will be announced separately at the time of their introduction, and the applicant can benefit from these programs by joining them.
28. Restrictions on Platform Use for Minors: Individuals who are below the legal age in their country of residence are not permitted to use the Global platform. If the applicant is under the legal age, platform use is only possible with the consent and supervision of a parent or legal guardian.
29. Technical Requirements for Platform Use: The applicant is responsible for using appropriate devices and a stable internet connection to access the Global platform. Global holds no responsibility for technical issues arising from inappropriate devices or weak internet connections.
30. Privacy in Consultation Sessions: The applicant must ensure that consultation sessions are held in a secure and private environment to prevent any privacy breaches. Global recommends that the applicant uses headphones and a high-quality camera during sessions.
31. Refund and Cancellation Policies for Sessions: Global has specific refund and cancellation policies for sessions, which are stated on the platform’s website. The applicant must read and be aware of these policies before booking a session.
32. Support for Applicants with Special Needs: Global is committed to providing high-quality services to applicants with special needs. The applicant can specify their special needs when booking a session to ensure that the appropriate doctors are selected for the consultation.
33. Regulations for Conduct with Other Users: The applicant is obligated to refrain from any inappropriate or offensive behavior towards other users or doctors while using the platform. Global reserves the right to limit or terminate the applicant’s access to the platform in case of any violations of these regulations.
34. Platform Modifications and Updates: Global reserves the right to make changes to the platform or add new features at any time. The applicant is responsible for familiarizing themselves with and complying with new modifications and updates.
35. Contacting Global: The applicant can contact Global through the communication methods provided on the platform’s website. Global’s support team is committed to responding to applicants’ questions and issues as quickly as possible.
36. Payment Information Protection: Global is committed to protecting the applicant’s payment information, including credit card numbers and other financial details. All financial transactions are conducted through secure gateways, and the applicant’s financial information is stored on secure servers.
37. 24/7 Technical Support: Global provides 24/7 technical support to its applicants to assist them in resolving any technical issues. The applicant can contact the support team through online chat or email.
38. Supplementary Consultations and Referrals to Specialists: If the doctors on the platform determine that supplementary consultations or referrals to other specialists are necessary, the applicant is required to cooperate and follow up on the supplementary or referral consultations.
39. Use of Artificial Intelligence in Diagnosis and Consultation: Global may use artificial intelligence technologies to assist doctors in providing consultations. However, the final responsibility for the diagnosis and recommendations lies with the doctor.
40. Changes in Service Prices: Global reserves the right to change the service prices at any time. However, any price changes will only apply to new bookings, and applicants who have already booked and paid for services will not be affected.
41. Accuracy of Communication Language: The applicant is responsible for ensuring that the language used during consultation sessions is accurate and clear. If there is a need for translation services, Global may provide them for an additional fee.
42. Consent to the Terms and Conditions of Third-Party Services: By using the Global platform, the applicant agrees to the terms and conditions of any third-party services that may be used during the consultation sessions. Global is not responsible for the terms and conditions or privacy policies of third-party services.
43. Suspension or Termination of Platform Services: Global reserves the right to suspend or terminate platform services temporarily or permanently for any reason, including maintenance, upgrades, or other technical requirements. Applicants will be notified of any service suspensions or terminations in advance, whenever possible.
44. Right to Record Sessions: Global reserves the right to record consultation sessions for quality assurance and training purposes. The applicant will be informed in advance if a session is to be recorded, and the applicant’s consent will be obtained before the recording.
45. Exemption from Liability for Incomplete or Inaccurate Diagnoses: Global and its doctors are exempt from liability for any incomplete or inaccurate diagnoses resulting from the applicant’s failure to provide complete or accurate information.
46. Subscription Rights and Obligations: Global Company may offer monthly or annual subscriptions for access to its various services. The terms and conditions of these subscriptions will be provided separately at the time of purchase, and the applicant is required to adhere to them.
47. Account Deletion: The applicant can request the deletion of their account at any time. Global Company is obligated to delete the applicant’s account as soon as possible after receiving the request, although certain financial transaction information may be retained for a specified period due to legal requirements.
48. Use of Cookies and Similar Technologies: Global Company uses cookies and similar technologies to enhance the user experience. The applicant can disable cookies through their browser settings, but this may limit access to some features of the platform.
49. Pre-Use Training: Global Company recommends that the applicant review the necessary training materials, such as videos or articles available on the website, before using the platform to make the best use of the available services.
50. Review and Amendment of Terms of Use: Global Company may review and amend the terms of use of the platform at any time. These changes will automatically take effect after being published on the website, and the applicant is required to comply with them.
51. Limitation of Liability for Incorrect Information: The Global platform is not responsible for the accuracy, completeness, or timeliness of the information provided by doctors during consultation sessions, and the full responsibility for using this information lies with the applicant. The applicant agrees that Global acts solely as an intermediary and is not responsible for the content provided during consultation sessions.
52. Disclaimer of Liability for Consultation Results: The applicant acknowledges that the Global platform is not responsible for the outcomes or consequences of using the consultations provided by doctors, and any decision or action based on these consultations is the responsibility of the applicant.
53. No Guarantee of Service Quality: The Global platform does not guarantee the quality, reliability, or results of the consultations provided by doctors. The responsibility for evaluating and selecting a doctor lies with the applicant.
54. Responsibility for Communication: The Global platform is not responsible for communication issues between the applicant and the doctor, including internet problems, insufficient device charge, or any other disruptions during consultation sessions.
55. Intellectual Property Rights: All materials, tools, software, and content provided by the Global platform are protected under Canadian intellectual property laws, and any unauthorized use without written permission is prohibited. The applicant agrees not to violate these rights.
56. Privacy Policy: The Global platform is committed to protecting the personal information of applicants in accordance with Canadian privacy laws. However, the Global platform is not responsible for the disclosure of information by third parties (including doctors).
57. Modification and Amendment of Terms: The Global platform reserves the right to modify and amend the terms and conditions at any time. Changes will take effect immediately upon official announcement, and continued use of the platform constitutes acceptance of these changes.
58. Force Majeure: The Global platform is not responsible for any delay or failure to perform obligations due to events beyond its control, including natural disasters, cyberattacks, or technical issues.
59. Right to Block User Accounts: The Global platform reserves the right to temporarily or permanently block the applicant’s account if the terms and conditions are violated or if the platform is misused. In such cases, no refund will be provided to the applicant.
60. Prohibition of Access for Illegal Purposes: The applicant agrees not to use the Global platform for illegal purposes. The Global platform is not responsible for unauthorized or illegal use of its services by the applicant.
61. No Liability for Software Errors: The Global platform is not responsible for software errors, viruses, or technical issues that may affect the applicant’s device.
62. Governing Law: This agreement is governed by the laws of the Province of Ontario and the federal laws of Canada, and any disputes arising from this contract must be resolved under these laws.
63. Entire Agreement: These terms and conditions, along with the privacy policy and other policies announced by the Global platform, constitute the entire agreement between the applicant and Global, and any prior or concurrent agreements in this regard are nullified.
64. Limitation of Liability for Damages: The applicant agrees that the Global platform is not liable for any direct, indirect, special, or consequential damages arising from the use of the platform, and the maximum amount of compensation is limited to the amount paid by the applicant for the consultation.
65. Applicant’s Consent and Awareness: By registering and using the services of the Global platform, the applicant declares that they have read and understood all the terms and conditions of this contract. Registration and use of the services constitute full acceptance of these terms.
66. Non-Transfer of Obligations: The applicant agrees not to transfer their obligations under this contract to any other person or entity. Global platform reserves the right to transfer its obligations to any other entity or individual.
67. Arbitration Agreement: Any dispute arising from these terms and conditions must be resolved through arbitration in accordance with the laws of Ontario, Canada. Each party will select one arbitrator, and if they cannot agree, a third arbitrator will be chosen as a mediator. The arbitration decision is final and binding.
68. Responsibility for Compliance with Local Laws: The applicant is responsible for complying with all local laws and regulations related to the use of Global platform services. The Global platform is not responsible for violations of local laws by the applicant.
69. Time Limitation for Claims: The applicant agrees that any claim arising from this contract must be filed within one year of the occurrence of the incident; otherwise, the claim will be time-barred and cannot be brought forward.
70. No Responsibility for User-Generated Content: The Global platform is not responsible for content created or provided by users (including doctors), and the full responsibility for this content lies with the user who created it.
71. Commitment to Proper Use: The applicant agrees to use the Global platform appropriately and refrain from any activities that may damage or disrupt the platform’s functionality. Global platform reserves the right to limit or block access if this commitment is violated.
72. Email Notification: Any notifications or announcements from Global platform will be sent via email. The applicant is responsible for providing the correct email address and is accountable for any failure to receive notifications.
73. Limitation on the Number of Accounts: Each applicant is allowed to have only one account on the Global platform. If multiple accounts are identified, the Global platform reserves the right to block all related accounts.
74. Opting Out of Research Participation: The Global platform reserves the right to invite applicants to participate in research and studies aimed at improving services. The applicant has the right to opt out of these studies, and opting out will not affect their use of services.
75. Right to Change Doctors: The Global platform reserves the right to change the doctor associated with the applicant if necessary. Efforts will be made to choose the best replacement for the applicant.
76. Confidentiality Guarantee: The Global platform commits to keeping all applicant information confidential and preventing its disclosure to third parties (except related doctors), unless required by law.
77. Recording Consultation Sessions: The Global platform may record consultation sessions for quality assessment and service improvement purposes. These recordings are for internal use only and will not be publicly disclosed or transferred to third parties without the applicant’s consent.
78. No Use of Services for Medical Diagnosis and Treatment: The Global platform emphasizes that the services provided are for consultation purposes only and should not be considered a substitute for real medical diagnosis and treatment. Applicants should consult qualified doctors for real medical treatment if needed.
79. No Responsibility for External Content: The Global platform is not responsible for links, external content, or websites connected to the platform. Access to such content and websites is at the applicant’s own risk, and Global platform assumes no responsibility.
80. Platform Access Limitation: The Global platform reserves the right to temporarily or permanently limit access to services in case of violation of terms and conditions, unauthorized behavior, or the need for maintenance and updates. In such cases, the Global platform assumes no responsibility for any damages.
81. Communication with Doctors: The Global platform is not responsible for the quality or manner of communication between the applicant and the doctor. The platform only acts as an intermediary to facilitate communication and is not responsible for communication problems or interactions between the applicant and the doctor.
82. No Responsibility for Changes in Services: The Global platform reserves the right to make changes and updates to its services at any time. These changes may include modifications to features, costs, or other aspects of the services. By using the platform, the applicant accepts and is aware of these changes.
83. Final Decision on Disputes: In case of disputes related to the use of the Global platform, the final decision is made by the management of the platform and is binding on all parties.
84. Right to Publish User Testimonials: The Global platform reserves the right to publish testimonials provided by applicants on the website or other marketing channels, with the applicant’s consent.
85. Commitment to Providing Services: The Global platform commits to providing the services as described in the terms and conditions, but does not guarantee continuous availability and is not responsible for disruptions due to technical issues, maintenance, or other reasons beyond its control.
86. Limitation of Liability for Third-Party Content: The Global platform is not responsible for content provided by third parties on the platform, including advertisements or external links. The full responsibility for using this content lies with the applicant.
87. Acceptance of Amendments: By continuing to use the services after amendments to the terms and conditions are published, the applicant indicates acceptance of these changes. If the applicant does not agree with the changes, they must stop using the services immediately.
88. Jurisdiction for Legal Matters: In the event of legal disputes related to this contract being referred to court, the jurisdiction for any claims will be the Province of Ontario, Canada, and the applicant agrees to this.
89. Agreement to Use Services for Legal Purposes: The applicant agrees to use the Global platform services only for legal purposes and to refrain from any activities that might unlawfully harm the platform’s services.
90. No Responsibility for Changes in Laws: The Global platform has no responsibility for changes in laws and regulations that might affect the use of services. The responsibility for compliance with new laws rests with the applicant.
91. No Warranty for Third-Party Services: The Global platform makes no warranties regarding the quality, reliability, or outcome of services provided by third parties (including doctors), and any issues related to these services are the applicant’s responsibility.
92. Establishment and Enforcement of Internal Rules: The Global platform may establish specific internal rules and policies for managing and supervising platform activities. These rules must be fully adhered to by applicants, and non-compliance may lead to disciplinary actions by the Global platform.
93. Right to Restrict Access: The Global platform reserves the right to temporarily or permanently restrict access to an applicant’s account if misuse or abuse of services is identified.
94. Agreement to Follow Platform Instructions: The applicant agrees to carefully follow all instructions and guidelines provided by the Global platform and to avoid any violations.
95. Waiver of Legal Claims: By using the Global platform services, the applicant waives any legal rights or claims related to the use of the platform that may arise under the existing terms and conditions.
96. Agreement to Avoid Misuse: The applicant agrees not to use the Global platform for abusive or illegal purposes and to conduct all activities within the framework of current laws and regulations.
97. Right to Use Feedback and Suggestions: The Global platform reserves the right to use feedback and suggestions received from applicants to improve services. These comments will not be published publicly unless explicitly permitted by the applicant.
98. Commitment to International Laws: The applicant agrees to comply with all international laws and regulations related to the use of Global platform services and to avoid violating these laws.
99. Waiver of Objection to Terms Changes: By using the Global platform services, the applicant agrees to waive the right to object to changes in terms and conditions and will fully accept and adhere to updated terms.
100. Compliance with Data Protection Laws (GDPR): The Global platform is obligated to comply with all data protection laws, including the General Data Protection Regulation (GDPR) in the European Union. This includes the collection, storage, and processing of applicants’ personal data. Applicants have the right to request access, correction, or deletion of their personal data in accordance with GDPR.
101. Cookies and Similar Technologies: The Global platform may use cookies and similar technologies to collect information about how the site is used. Users are required to be aware of cookie usage through their browser settings and can change their settings to block cookies. The use of cookies on the platform is intended solely to enhance performance and user experience.
102. Privacy and Security: The Global platform values user privacy and takes all necessary security measures to protect personal data. However, the platform has no responsibility for unauthorized disclosure of personal data due to security breaches by third parties.
103. No Insurance Coverage: The Global platform does not provide any insurance coverage for medical consultations provided through the platform. Applicants should be aware that consultations from doctors are general and informational only, and there is no insurance coverage for medical treatments or consultations.
104. Verification of Doctors’ Credentials: The Global platform makes efforts to verify doctors’ credentials in their respective regions. However, applicants should be aware that doctors may not hold licenses in their country or region, and consultations provided on this platform are considered informal and informational, not including licensure in other areas.
105. Awareness of Limitations: By accessing the Global platform and using its consultation services, applicants confirm that they are aware that doctors may operate in different countries and their licenses may be limited to specific regions. This means that doctors cannot provide official medical services in Canada or other countries and that only remote advisory services are available.
106. Legal Limitations: The Global platform is not responsible for non-compliance with local or international laws that may arise due to differences in doctors’ licenses or other legal issues. Users must take full responsibility for their decisions and actions in using the platform’s services.
107. Changes to Terms and Conditions: The Global platform reserves the right to periodically change the terms and conditions. New changes will be published online, and continued use of the platform signifies acceptance of the updated terms and conditions. Users are responsible for regularly reviewing the terms and conditions for any changes.
108. Governing Law and Dispute Resolution: These terms and conditions are governed by the laws of the Province of Ontario, Canada, and any disputes arising from this agreement must be resolved in the competent courts of Ontario.
109. Independence of Service Providers: The platform does not directly provide medical or advisory services. All service providers act independently of the platform, and the platform only serves as an intermediary for connecting users with these providers. Any information or advice received from service providers is their responsibility, not the platform’s.
110. Geographical Location: The applicant confirms that they are physically present at the location they have selected as their current place of residence and agrees to communicate with service providers through the platform only while present at this location. The applicant also confirms that their ability to access and use these services depends on the accuracy of this confirmation.
111. No Guarantee of Results: The content available on the platform, other than information directly received from service providers, should not be considered medical advice. Always consult a licensed healthcare professional for diagnosis and treatment. The platform does not assume responsibility for medical advice provided and makes no guarantees regarding the safety, suitability, or effectiveness of any specific medication or treatment.
112. Responsibility for Password Security: The applicant is solely responsible for the security of their username and password and must not share them with third parties or allow others to access services using their credentials. The applicant agrees to notify the Global platform immediately in case of any suspected misuse of their password or username.
113. Representative for Individuals with Physical Disabilities: If a representative is using the services on behalf of an elderly person with special needs, including but not limited to vision and hearing impairments, they must be present during any video or physical consultations with the doctor. They must also be available at the delivery location after the purchase of any product. The applicant is responsible for paying for the services provided and arranging the purchase and delivery of products for the elderly person and assumes the obligations of this agreement in relation to the elderly.
114.Recording and Documentation of Sessions: The applicant must not record interactions with medical service providers through the app in any media.
115: Purchasing from the Store: All orders are subject to acceptance by the Marketplace Providers, and each order accepted by the providers constitutes a separate contract between the provider and the applicant. The applicant acknowledges that unless a notice of order acceptance, including dietary supplements and sports products or arrangements for an appointment, is received from the Marketplace Provider, the providers will not have any legally binding contract with you for the sale or any other transaction related to the products offered. Consequently, the providers will not be liable for any damages that may result. The Marketplace Provider reserves the right to refuse to process or accept any order received through the platform at its sole discretion.
Applicant Session Cancellation and Refund Policy:
- Cancellation by Applicant (More than 48 hours before the session): If the applicant cancels their session more than 48 hours before the scheduled time, the full session fee will be refunded to the applicant, or at the applicant’s discretion, it can be rescheduled for another session.
- Cancellation by Applicant (Less than 48 hours before the session): If the applicant cancels their session less than 48 hours before the scheduled time, a portion of the session fee (e.g., 50%) may be deducted, and the remainder will be refunded to the applicant. However, in special cases (e.g., emergencies), exceptions to this policy may be made.
- No-show without Prior Notice: If the applicant does not show up for the session without prior notice, the session fee will be entirely non-refundable.
These policies are part of the cancellation and refund policy that may be applied by the Global Clinic platform and are designed to provide transparency and protect the rights of both parties in the online consultation process.
